Article 15. Employee rights related to law enforcement service The Law on Law Enforcement Service

     1. Employees have the right to:

     1) obtaining, in accordance with the established procedure, information and materials necessary for the performance of official duties;

     2) familiarization with the regulations, other documents defining their rights and official duties, and the conditions of their nomination;

     3) access in accordance with the established procedure in connection with the performance of official duties to state bodies, organizations, regardless of their organizational and legal form;

     4) access, in accordance with the established procedure, to information constituting state secrets and other legally protected secrets, if the performance of official duties is related to the use of such information;

     5) creation by the law enforcement agency of the conditions necessary for the performance of official duties and professional development;

     6) promotion based on the results of professional activity, length of public service and qualification level;

     7) familiarization with reviews of their professional activities and other documents prior to their entry into the personal file, the materials of the personal file, as well as to attach to the personal file their written explanations and other documents and materials;

     8) professional retraining, advanced training and internship in accordance with the procedure established by this Law and other regulatory legal acts of the Republic of Kazakhstan;

     9) state protection of one's life, health and property, life, health and property of one's family members in accordance with the legislation of the Republic of Kazakhstan;

     10) protection of your personal data;

     11) applying to higher-ranking officials, higher authorities or a court to protect their rights and legitimate interests, as well as to resolve individual disputes related to law enforcement service;

     12) medical and sanatorium-resort services;

     13) pension provision in accordance with the legislation of the Republic of Kazakhstan on social protection;

     14) housing and social security;

     15) appropriate organizational, technical and sanitary conditions of service, taking into account the specifics of the law enforcement service;

     16) rest in accordance with this Law and the labor legislation of the Republic of Kazakhstan;

     17) carrying out teaching, scientific or other creative activities;

     18) the use of appropriate temporary detention facilities, pre-trial detention facilities in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan;

     19) escorting detainees and persons in custody.

     2. Employees, with the exception of employees of civil protection agencies, are granted the right to carry, store and use firearms and other weapons and special equipment. They also have the right to use physical force, including fighting techniques. The procedure for the use of firearms and other weapons, special means and physical force is determined by this Law.

     3. Employees, in accordance with the tasks assigned to them, within the limits of their competence, are granted other rights provided for by the laws of the Republic of Kazakhstan regulating the activities of law enforcement agencies.

     4. The procedure for escorting detainees and persons in custody is approved by the head of the law enforcement agency.

 

 

The Law of the Republic of Kazakhstan dated January 6, 2011 No. 380-IV.

     This Law regulates public relations related to admission to the law enforcement service of the Republic of Kazakhstan, its passage and termination, and also defines the legal status (status), financial support and social protection of law enforcement officers of the Republic of Kazakhstan.
